    The Will of Mr Samuel
    Cobb of Stokeford in the Parish
    of East Stoke Dorset Brickmaker
    and Farmer
    This is the last Will and Testament of me Samuel Cobb of Stokeford in the Parish of East Stoke in the Country of Dorset Brickmaker and Farmer which I make as follows (that is to say) First I direct that all my just debts funeral and testamentary expenses be paid and discharged by my Executors hereinafter named then I Give and bequeath all my wearing apparel of every description to be equally divided between and amongst all and every my several children namely Amos, Arthur, Eliza, Elizabeth, Jane, Mary Ann, Abigail, Samuel and Thirza Cobb in equal shares and proportions that they may arrange the division amongst themselves. And as to all the rest residue and remainder of my real and personal estate monies, securities for Money, live and dead Stock, crops, Farming utensils and implements household goods, furniture chattels and property of which I may die possessed or entitled to at the time of my decease or over which I have a disposing power I Give devise and bequeath the same and every part thereof unto William Pitt of Heffleton in the said Parish of East Stoke Yeoman and John Hobbs the elder of Wareham in the said County Bricklayer and their heirs executors administrators and assigns Upon trust that they the said William Pitt and John Hobbs or the survivor of them or the heirs executors administrators or assigns of the survivor so and shall with all convenient speed after my decease make or cause to be made an inventory of all my estate and effects and to permit my wife Jane and my said children to dwell and remain in my said Dwellinghouse and premises at Stokeford aforesaid for the remainder of my term and interest therein provided they all behave well and agree together otherwise to be at the sole discretion of my said trustees and executors and upon further trust that they my said trustees and the survivor of them do carry on my said business of Brickmaking and farming with the assistance of the said sons Amos Cobb and Arthur Cobb (who shall be paid for the labour by my said trustees) And I further direct that my said trustees shall once in each and every year make out and balance an account of the receipts and expenditure by them in the management and carrying on my said business and divide the profits arising therefrom between my said wife (provided she remains a widow and conducts herself properly) and my aforesaid Children (and any other Child who may be born to my said wife in due time after my decease) or such of them as may at such several times be living, in equal shares and proportions. And I authorize and empower my said trustees and the survivor of them at his or their discretion to discontinue my said business or any part thereof and to convert the materials stock used in and about the same into Cash and (after payment thereout of all expenses which they may incur) to invest the produce thereof with any ready monies that may be in their hands in the parliamentary Stock or public funds of this Kingdom in their or his names or name or to place it out on any other good and sufficient Security at their discretion and do and shall stand possessed of the interest dividends and annual proceeds thereof upon trust equally to divide the same unto between and amongst my said wife for her life provided she remains a widow and conducts herself properly, and all and every my said Children in equal shares and proportions. And from and immediately after my said Wifes decease second marriage or the committal of such indiscreet and improper conduct as aforesaid and of which my said trustees shall be satisfied then In trust to pay distribute and divide the whole of my said residuary property between and amongst all and every my said Children their heirs executors administrators and assigns equally to be divided between them as tenants in common and not as joint tenants to the entire exclusion of her my said wife. And direct that my said trustees shall permit my said wife to reside in the Dwelling house and premises which I now occupy, with my said Children for her life, or during so long time as she remains my widow and unmarried, but should she marry again or at any time during her widowhood acting in an indiscreet or improper manner then I direct that immediately on either of these events taking place she shall be for ever deprived of all the interest and benefit to which she may be entitled under this my will, which interest and benefit shall be divided between and amongst my said children at the discretion of my said trustees and executors in addition to the shares so allotted to them Provided always and I hereby direct that it shall be lawful for my said trustees or the survivors of them by and out of the monies that may come to their or his hands under the trusts aforesaid to deduct to themselves or himself the costs charges and expenses which they may bear pay or sustain in the management or execution thereof and that neither of them shall be liable for the other of them or for any more money than they or he shall actually receive or for any loss sustained through any Banker Broker or other person in whose hands any part of the trust funds may be deposited for safe custody or for any other loss whatsoever unless the same should happen through their or his own wilful neglect or default Provided likewise that if either of my said trustees shall die, or become unable or unwilling to perform the trusts of this my Will I hereby authorise and direct such trustee as shall continue able and willing to act and the executors or administrators of the surviving able and willing trustee to appoint a new trustee in his or their stead. And I declare that the receipts and releases of my trustees shall be valid discharges in respect of the matters to which they relate and the parties taking the same shall not be liable for any subsequent loss or misappropriation by my trustees. And lastly I nominate and appoint the said William Pitt and John Hobbs the elder executors of this my will In witness whereof I the said Samuel Cobb to this my last Will and testament contained in three sheets of paper affixed together have to the first two sheets thereof set my hand and to this third and last sheet thereof my hand and seal this seventeenth day of June One thousand eight hundred and forty eight

    This is a Codicil to the last Will and Testament of me Samuel Cobb of Stokeford in the parish of East Stoke in the Country of Dorset Brickmaker and Farmer which bears date the seventeenth day of June one thousand eight hundred and forty eight. Whereas I have by my said Will appointed my Friends William Pitt of Heffleton in the said parish of East Stoke Yeoman and John Hobbs the elder of Wareham in the said County Bricklayer my trustees and executors, and I am now desirous of appointing my two sons Amos and Arthur Cobb to be my trustees and executors to my said Will in the room of the said William Pitt and to act jointly in the trusts thereof with the said John Hobbs the elder. Now therefore I do hereby revoke the several devises and bequests and the appointment of trustees and executors in my said will contained so far as respects the said William Pitt and I do hereby nominate and appoint my said two sons Amos Cobb and Arthur Cobb to be my trustees and executors of my said Will in the place of the said William Pitt and to act jointly with the said John Hobbs the elder in the trusts and power thereof. And I do hereby direct and declare that my said will shall be read and construed and shall have the same operation and effect in all respects as if the names of my said two sons Amos Cobb and Arthur Cobb had been throughout in every instance inserted in my said Will instead of the name of the said William Pitt. And it is my further desire and request that my said trustees and executors shall at their discretion advance for the benefit of each and every of my children in whole or any part of such childs expectant share under my said will. And in all other respects I hereby ratify and confirm my said Will.     SAMUEL COBB AND FAMILY
    Samuel COBB was born and baptised in the village of East Stoke, Dorset in 1796, the youngest child of William and Margaret. William died in 1811 and during the last ten years of his life at least, before Samuel was of an age to be earning his living, the family suffered much hardship. However, with the death of his mother in 1812, although only 16 years old, Samuel, and his sister Abigail, probably thought their troubles were over as they, together with their grandmother, Elizabeth CHICK, were the beneficiaries named in Margaret’s Will. The Will could, however, have been challenged, perhaps by William, John and David, brothers to Samuel, as it was not proved until 1819 for less than £100. Or perhaps Samuel and Abigail did not have the Will proved until after the death of their grandmother in 1818. In 1819 Samuel had a Cottage and Enclosure rated at £2. 3s. 0d on which his assessment was 8/6d. He still lived in the property in 1821 but the owner was a Mr Bond.
    In the same year, Samuel married Elizabeth Arabella BROWN in the Church of St Mary the Virgin in East Stoke. They moved to Blandford where their first two children were born, returning to East Stoke before the arrival of their third child in 1826. Three other children were born before 1835 when at 32 years of age, Elizabeth Arabella died. His children were aged from 2 to 14 years but within six months Samuel had married again, to Jane CHAMP. Amos COBB described his step-mother as being “very kind”.
    For some reason, on the night of the first census in 1841, the family were not all living together. On that night, as Thirza, the eldest daughter, had died in 1836, Amos at 17 was the oldest in the family. He, together with his brother Arthur, sister Eliza and his 3 year old step sister, Abigail, were living in Creech, whilst Samuel and Jane with their own daughter, Mary Anne, together with Elizabeth and Jane by his first wife, were in Stokeford. 
    Several events occured during the next ten years. A son Samuel was born in 1842, dying two years later. Three months after his burial another Samuel was baptised, followed by Thirza (1846) and Charles John (1849). In that year Arthur married Elizabeth MARSH, and Elizabeth married her cousin David COBB.
    It would appear that over the years Samuel was able to rent several plots of land. On the 13th September 1847 he had made an agreement with a William GOODWIN to rent a cottage, ‘tenement’, garden, fuelhouse, together with a piece of ground and a field, then both arable, called Home Close and Poor Close, the latter including the withy bed, all amounting to about four acres and situated in Highwood, in the parish of East Stoke, Dorset. The rent was £10 a year and in addition Samuel had to pay any rates which came due on the property. He was allowed £3. 12s. 2d. in the first two years for repairs which were the responsibility of the previous tentant, but thereafter he had to keep the property in “good tenantable repair” and “manage the land in a proper husbandlike manner”. The agreement was for seven years but then, in the Spring of 1851 Samuel died at the age of 54. Nevertheless, it could be that by this time he was renting several other plots of land. Six years before his death, at the time of the Tithe Apportionment in 1845, a Samuel COBB rented Arable land from Elizabeth ANGEL for 2s 5d. At the same date David BARNES rented a Garden, 2 Arable plots and Rough-Furze to a Samuel COBB for a total of 9s 2d. It is also possible that Samuel still had his original holding rented for 1s 8d from the Reverend Nathaniel BOND who was the largest landowner in the Parish of East Stoke. 
    Samuel was employed in several occupations during his life, Labourer, Brickmaker, Brickburner, Tradesman, Farmer and Builder. Directories show him as a Shopkeeper in 1848, and a Grocer and Dealer in 1851, but his will refers to him as Brickmaker and Farmer. In this document he appears to have little confidence in the future behaviour of his wife, Jane, and following his death his affairs were to be organised by his friend, John HOBBS and the sons by his first wife, Amos and Arthur COBB. Amos went to America, while Arthur spent the rest of his life in Creech, Church Knowle, Dorset. 
    Your Oath is that the within named Samuel Cobb died on or about the twenty eighth day of February One Thousand Eight Hundred and fifty one. That the writing hereunto annexed contains his true last will and testament (with codicil hereto annexed) as far as you know or believe. That you are the joint Executors named in the said will and codicil and that you will truly perform the same by paying first his debts and then the legacies contained in the said will and codicil as far as the goods chattels and credits will thereto extend and the Law requires that you will make a true and perfect inventory of all the said goods chattels and credits and exhibit the same into the Register of the Court of the Archdeacon of Dorset at the time assigned you by the said Court and render a just account hereon when thereto lawfully required. And lastly that the contents of the annexed affidavit to which you have subscribed your names were and are true

The idea of these charts is to give the information that we have found in the research we have done and put together and with the help of many other people who have contacted us over the past thirty odd years we have been researching our family. To conform to the Data Protection Act all the Charts have been altered to exclude all details for living people other than the name.
