    I had information that James was transported to Australia but I do not think this was the case. It appears he came with his parents and was a Policeman for sometime so I would not think he was a convict. The James SIMMONS we had was convicted in Chatham, which is actually some distance from Ramsgate, so I think this was another James SIMMONS

(Australian Electoral Roll) There were various other SIMMONS on this Electoral Roll - a John Gisby jun a Farmer, a John Arney (I think this should be AMEY) a Labourer born Gelliondale, then there is a Margaret SIMMONS Alberton home duties. There are two others who I do not think are related.
    On 31st January 2011 I received the following information from a Mary SIMMONS:
    I wanted to add a bit of information on his brother James Gisby Simmons. I think that he was transported to Van Diemens land 30/2/51. I think that he was involved in tin mining in Victoria possibly marrying the owners daughter and later became a farmer. I think that he died 15/10/1918 having had children. He lived in Gelliondale and had at least 2 sons one of whom was called George Web Simmons. I think he was buried at Foster cemetery in Victoria. I cannot remember where I found the info on his father Joseph but I think that he may have gone out to Australia after the death of his wife Elizabeth (nee Gisby) and died there.

    TOORA. - The death is announced of Mr. James Gisby Simmons, one of the best known pioneers of South Gippsland. Mr. Simmons who was 82 years of age, was born at Ramsgate, Kent, Kengland and arrived at Port Albert in 1852 with his perants. A few years later he joined the police force as coast ranger from Capte Liptrap to Wilson's Promontory. Subsequently he took up land near Alberton.

    NOTICE TO CREDITORS:_Pursuant to the Trusts Act 1915, notice is hereby given that all persons having claims against the estate of JAMES GISBY SIMMONS, Senior, late of Gelliondale, in the State of Victoria, retired farmer, deceased, who died on the fifteenth day of October, one thousand nine hundred and eighteen, are hereby required to SEND in PARTICULARS in writing to such CLAIMS to the undersigned, Backhouse, Skinner and Hamilton, of Main street, Foster, in the said State, proctors for James Gilby Simmons (formerly the younger), of Gelliondale aforesaid, farmer, and George Webb Simmons of Toora, in the said State, hotel owner (the executors to whom probate of the will of the said deceased was granted), addressed to the said Backhouse, Skinner, and Hamilton, on or before the first day of August, one thousand nine hundred and nineteen, after which date the said executors will proceed to distribute the assets of the said James Gisby Simmons, Senior, deceased, which shall come to their hands, having regard only to the claims of which the said executors shall then have had notice, and notice is hereby further given that the said executors will not be liable for the assets so distributed or any part thereof to any person who claim they shall not then have had notice as aforesaid.

    the executors named therein they having been first sworn that they would well and truly collect and administer according to law the estate of the said James Gisby Simmons Senior deceased and would exhibit and deposit in the office of the Master-in-Equity a true and perfect inventory of the said estate with three months of the order granting Probate and a true and just account of their administration of the said estate within fifteen months of the said order.
    This Grant is made upon the condition that no portion of the assets shall be distributed or paid during the War to any beneficiary or creditor who is a German, Austro-Hungarian, Turkish, of Bulgarian subject wherever resident, or to any one on his behalf, or to or on behalf, of any person resident in Germany Austria-Hungary, Turkey, or Bulgaria, of whatever nationality, with the express sanction of the Crown' and if any distribution or payment is made contrary to this condition the Grant of Probate or Letter of Administration will be forthwith revoked.

    I THOMAS HENDRA of Foster in the State of Victoria farmer make oath and say as follows.:
    1 That I am one of the subscribing witnesses to the last will of James Gisby Simmons Senior late of Gelliondale in the State of Victoria farmer deceased bearing the date the Fourth day of June One thousand nine hundred and eighteen and which said will is shewn to me at the time of swearing this my affidavit and marked with the letter "A".
    2. That the said James Gisby Simmons Senior executed the said will on the day of the date therefor by singing his name thereto " J. G Simmons Snr." at the foot of each of the three pages of a will form on which his will was written as the same now appears thereon in the presence of one James Paterson and myself this deponent both being present at the same time and we thereupon attested and subscribed the said will at the foot of each of the three said pages in the presence of the said testator and in the presence of each other.
    3. That as and prior to the execution of the said will as aforesaid the word "of" was struck out in the Fifth line, the word "the" was interline in the Eighth line, the word "unto" was converted to the word "into" in the Tenth line, the word "parts" was interlined in the Fifteenth line, the word "nineteen" was substitute4d for the word "eighteen" and the figures "1918" were interline in the Eighteenth line and the word "witness" was struck out in the Nineteenth line of the second page of the said will as all the several before mentioned substitutions, interlineations and erasures now appear and the said testator placed his initials "JGS" opposite the Filth, Eighth, Tenth, Fifteenth, Eighteenth and nineteenth lines

    We, JAMES GISBY SIMMONS (formerly the Younger) of Gelliondale in the Sate of Victoria farmer and George WEBB SIMMONS of Toora in the said State Hotel Owner make oath and say-
    1. That we are seeking to obtain Probate of the Will of the above-named James Gisby Simmons Senior deceased and are each of the full age of Twenty-one years.
    2. The said deceased died on the Fifteenth day of October 
    One thousand nine hundred and eighteen
    3. The said deceased as married at the time of this death
    4. The said deceased left a Will bearing date the Fourth day of June One thousand nine hundred eighteen which is as believe the last Will and Testament of the said deceased and which is unrevoked.
    5. That the testator was of the full age of twenty-one years at the date of the execution of the said Will.
    6. By his said Will the said testator appointed ourselves these deponents executors thereof.
    7, The paper writing now produced and shewn to me and marked "A" is the true last Will and Testament of the said deceased as we verily believe.
    8. The said Will was executed in the presence of James Patterson then and now of Foster in the said State farm laborer and Thomas Hendra then and now of Foster aforesaid farmer.
    9. The said deceased left real estate in the State of Victoria not exceeding the value of Nine hundred and forty  four pounds and personal property in the said State not exceeding the value of Four hundred and fifty eight pounds thirteen shillings and four pence making together the sum of One thousand four hundred and two pounds thirteen shilling and four pence as set out in the inventory hereunto annexed and marked "B" produced and shown to us at the time of swearing this our affidavit.

That if we obtain probate we will well and truly collect and administer according to law to the best of our knowledge and ability the property, lands and hereditaments goods, chattels and credits of the said deceased at the time of his death which at any time after shall come to the power or control hands or possession of us as his executors or of any other person or persons for us that we will make or cause to be made a true and perfect inventory of all and singular the property, lands and hereditaments, goods chattels and credits of the said deceased which shall have come to the hands possession or knowledge of us or to the hands or possession of any other person or persons for us and the same so made will sign with out proper handwriting and will exhibits and deposit or cause to be exhibited and deposited the same inventory in the office of the Master-in-Equity within three calendar months next ensuing the order granting Probate and further that we will make or cause to be made a true and just account of the administration of the estate which we have undertaken as to our receipts and disbursements and as to what portion is retained by us and what portion remains uncollected and the same so made will sign with out proper handwriting and will exhibit and deposit or cause to be exhibited and deposited the same account in the said office of the Master-in-Equity with fifteen calendar months next ensuing the order granting Probate.

    From Amey History by John Thomas Doran
    By 1914 James Gisby Simmmons had sold his proertyto live a private life intending to live with his children, spending a few weeks with William in Waga, Alice in Junee and Charlotte in Foster.
    His wife suggested that they should move to New South Wales. James replied "You can go wwhen your're ready. I'm staying here until I die I'm going to be buried in Foster, beside my Mother-in-Law, Ellen Amey". His wish was respected. Charlotte went to NSW but made frequent trips back to Foster and was there when James died, but returned to NSW where she died in 1920.
    Her remins were brough back Foster, where she was buried with James beside Ellen Amey.
    During the years he spent in out home he never tired of relating his experiences of his early life at sea and as a policeman

    There is a John Amey SIMMONS junior so assume John Amey married and had at least one child.
